These are the terms and conditions which apply to your purchase of goods from the ROOST web site at www.roost-uk.com. The website and goods are provided by ROOST ("we", "us", "our"). When we refer to "you" and "your" we mean the user of the website and purchaser of goods.

These terms and conditions form a legally binding contract between you and us. Your acceptance of the terms and conditions is given when you purchase goods from us. You should read these terms and conditions carefully before buying anything from this website.

We reserve the right to change the terms and conditions under which the website and the goods are provided. Any such change in terms and conditions will be effective to all new orders once included in the text of these terms and conditions and published on the website. Information about the Website and the Goods

This section sets out some terms about the information on the website, descriptions of goods and how you use the website.

We try to make sure that all information on the website, including descriptions of our goods, and listed prices, are accurate and correct at all times. We will try to resolve all information errors on the website as soon as reasonably possible, and if such an error has affected your purchase of goods we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the website.

You should bear in mind that buying gifts, homeware, jewellery, clothing and accessories over the internet provides a different shopping experience to buying in-store. In particular you acknowledge that:

• The colours which are shown for the goods on the website will depend on many factors – including your display settings.
• All sizes and measurements are approximate.
• All goods are subject to availability - we may not be able to supply your order.
• Any delivery estimates given on the website or by email are estimates only.

Purchasing Goods Online

This section sets out some terms which apply to your purchase of goods from us through our website.

You make an offer to purchase a product from us (your "order") by completing the staged process on the website as set out below:

• Adding product to your shopping basket 
• Enter billing address details 
• Enter delivery address details 
• Confirmation of order 

Your order only constitutes an offer to purchase goods from us, and does not form a binding contract until accepted by us. Where you order more than one product your order contains a series of offers for each product individually. On receipt of your order, we will send you an order acknowledgement email to the email address which you provide in the order process. 

This order acknowledgement email will contain your order number, details of the goods ordered and a delivery estimate. Note that this email is only to acknowledge that your order has been received, and is not acceptance by us of any offers to purchase goods. We must receive full payment of the price of the goods before we can accept any offers.

An offer made by you to purchase a product shall only be deemed to be accepted by us when we despatch that product to you and send you an order dispatch email which includes details of the product. We reserve the right to refuse any offers in an order prior to acceptance. If a product is not available we will include details of the unavailable product in the order despatch email. A product which is not available will not be included in the contract for a product which is dispatched.

All prices are shown in GB Pounds Sterling and are correct at time of publishing. Delivery charges will be applied based on the delivery address chosen and these will be displayed in the order process. All prices are, unless otherwise stated, inclusive of VAT and other applicable taxes.

Occasionally, due to circumstances beyond our control, it may be necessary to increase or decrease prices. We reserve the right to change the prices set out on this site without notice.

Discounts provided to customers only apply to full price products and are not valid on items quoted at sale price.

Liability

We endeavour to ensure that the information on the website is accurate and helpful at all times. However, we cannot ultimately warrant the accuracy of any information and cannot be held liable for any use or reliance you may make of it or put on it except as specifically agreed with us in any further agreement we may make with you in writing. Any use of this website or its contents, other than for your own personal, non-commercial use is strictly prohibited without the permission of ROOST.

Jurisdiction

The interpretation, construction, effect and enforceability of this agreement shall be governed by English law, and you and we agree to submit to the jurisdiction of the English courts for the determination of disputes.

Privacy and Security Statement

Here at ROOST-UK we would like to assure you that we are totally committed to protecting your privacy and security. As a result we have set out guidelines below that we use for protecting your personal information. Please do take the time to read the policy, we will up-date it occasionally so please do check it from time to time.

In order to provide you with the best possible customer service we need to collect and store information about you. Here at ROOST we do not sell, transfer or disclose any of your personal information to third parties apart from when processing payments to your payment provider and when accessing mailing tools (for example mail chimp and paperless post). The sole purpose of using mailing tools is to keep you up dated with new ROOST-UK news  / products / promotions and events. We only ever use the information you provide in accordance with the Data Protection Act of 1998.

The information we collect about you includes: your name, e-mail address, postal address, telephone number and your order details. Here at ROOST-UK we keep a record of any order you may place and any email correspondence. All this information is stored to ensure that we can provide the best possible customer service, deal with any questions, queries, problems, or complaints you may have and to ensure that any information we send you is relevant to you.

If for any reason you wish to check the information we hold about you then please do not hesitate to contact us (details at the bottom of this page). If any information is incorrect we will amend it immediately. Alongside this if you would like your information to be removed from our records we will happily do this with immediate effect. However, in keeping with our security procedures we may request proof of identity before disclosing sensitive information.

Regarding our online payments, we always do our best to make shopping at ROOST-UK as safe and secure as possible. We use high levels of security when dealing with payments online. Your credit/debit card details are not seen by us either during or after the transaction. Payment is taken by shopify payments (our website is built on the shopify platform) or paypal. We are currently looking also at how we accept amazon pay and apple pay.

We take extensive steps to avoid anyone intercepting your payment details between your computer and our secure server. You can be sure of this by checking the web address at Checkout as it will start with "https" instead of the normal "http". Also a key or small padlock will appear at the bottom of the web browser or in the address bar.

We will email you to confirm your order. You will be given the opportunity to decline marketing information from us including our monthly newsletter.

When someone purchases products not on our website we take payments using our handheld sum-up card machine. Again your credit/debit card details are not seen by us either during or after the transaction. If you wish to receive a receipt (either to your mobile phone or an e-mail address)  then this is sent, however, that information is not stored and we do not get any copies of any email or mobile phone numbers.

"Cookies" maybe stored on your internet browser and allow information to be collected about you so that you can be identified when you return to our website or when switching between pages. This allows us to provide our customers with a more personalised shopping experience.
